- 2.1 Submitting an Order: To purchase equipment or activewear, add items to your online cart and proceed to our secure checkout portal. Please carefully verify your selected items, sizes, quantities, and destination address before authorizing payment.

This confirmation does not constitute formal acceptance of your order. 5. Shipping, Delivery, and Transfer of Risk

- 5.2 Transfer of Risk and Title: Legal ownership (title) transfers to you once full payment is successfully captured. The risk of physical loss or transit damage shifts to you the moment we hand the package over to our commercial shipping carrier.
- 5.3 Delays Outside Our Control: We are not liable for transit disruptions caused by external forces (e.g., extreme weather, postal strikes, or carrier backlogs). If your shipment faces a prolonged, severe delay, you may request a cancellation and receive a full refund for any unfulfilled items.
6. Cancellation Rights, Guarantees, and Return Exceptions

7. Disbursing Refunds
- 7.1 Verification: All returns are meticulously inspected upon arrival at our warehouse. We reserve the absolute right to deny a refund or exchange if the gear is returned with signs of wear, sweat, deodorant markings, makeup stains, or structural damage.
- 7.2 Reimbursement Flow: Approved refunds are automatically credited back to your original payment route. If an order was funded via a combination of a gift card and a credit card, the refund balance will prioritize restoring the gift card allocation first.
8. Pricing Errors and Taxes

11. Dispute Resolution: Binding Individual Arbitration & Class Action Waiver
PLEASE READ THIS ENTIRE SECTION CAREFULLY. IT MANDATES THAT DISPUTES BE RESOLVED THROUGH ARBITRATION RATHER THAN COURT TRIALS AND ELIMINATES CLASS-ACTION REMEDIES.
- 11.1 Mandatory Arbitration: Any legal conflict, claim, or dispute arising out of or relating to your purchase of AMAFitness goods, marketing materials, website use, or these terms shall be settled exclusively through binding, private arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules.
- 11.2 Pre-Arbitration Consultation: Before initiating formal arbitration proceedings, you must submit a written statement detailing the factual basis of the claim and your requested remedy to our support team. The parties will make a good-faith effort to resolve the dispute informally within 30 days.
- 11.3 Individual Basis & Waiver: You and AMAFitness agree that all dispute resolution proceedings will be conducted solely on an individual basis. You explicitly waive the right to litigate claims in court, the right to a jury trial, and the right to initiate or participate in a class, consolidated, collective, or representative action.
- 11.4 Virtual Hearings: Arbitration hearings will be conducted virtually via video conference, unless the arbitrator determines an in-person venue is structurally necessary. Each party shall bear their own personal legal fees and costs unless the arbitrator explicitly determines that the claims brought were entirely frivolous.

A single arbitrator will resolve each batch consolidated under a single filing fee structure.
12. Governing Law and Severability
These Terms and Conditions are governed by and construed in accordance with local consumer protection frameworks, without giving effect to conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods is explicitly excluded from this contract.
If any individual clause, paragraph, or provision within these terms is declared unlawful or unenforceable by a court of competent jurisdiction, that specific provision will be severed, and the remaining segments will persist in full force and effect.
